Object Extent and scope of code of criminal procedure Object of criminal procedure ● The essential object of criminal law is is to to protect society against criminals and lawbreakers. ● therefore provisions for punishment are available substantive laws ● To execute provisions of substantive loss we have procedural law ● Code of criminal procedure provides for machinery for detection of crime, apprehension of suspected criminals, collection of evidence, determination of the guilt or Innocence of the suspected person Principles on which the code is established upon ● Fair trial ● All efforts to be made for speedy And fair investigation as well as trial ● Principle of natural justice must be followed ● Procedure should ensure fair deal to the poorer section of society Scope of the applicability of the code ● Investigation enquiry, or trial of offences ● Code makes provisiion for special law and gives it precedence over the procedure followed by CrPC ● Section 4 & 5 Code is exhaustive The draftsmen did all the possible efforts to make the horizon of the code as broad as possible. However, with changing time, procedures might lack in an aspect or two. Therefore, where the court finds that code has not made specific provision to meet any exigencies wrt certain situation, S 482 can be invoked.
