Episode 20 (5mar25) Today, I got a special OTA update for my car: Version 2025.2.8 According to various sources on X, it contains FSD Supervised Versions 12.6.4 & 13.2.8, running in shadow mode in Europe. The Release Notes can be found on NotATeslaApp ) Full Self-Driving in Shadow Mode, is a feature Tesla uses to test its autonomous driving software. Basically, the car runs the FSD system in the background while the driver’s still in control. It collects data on how the software would handle situations compared to what the driver does. That way, Tesla can refine the system without it actually taking over the steering wheel yet. Elon and other Tesla Top people announced the imminent introduction of FSD in Europe: "We are currently waiting for regulatory approval" How is the current status of Tesla FSD approval in Europe? The UNECE regulation for DCAS became totally irrelevant for Tesla: They use an end-to-end neural net system since version 12 of Tesla FSD. That system contains only minimal traditional coding. If they want to implement all the nitty-gritty micro-rules of the DCAS regulation, they must totally change the system and go back to mainly manual legacy coding. The UNECE regulation for ADS, which is also in the making, will in the future (2-3 years from now?) accept Tesla’s unsupervised FSD system, without that unacceptable return to an old architecture. You will remember that Tesla’s Marc Van Impe left his position as UNECE secretary for WP.29 and was offered a new job at SpaceX. Since about a year, Tesla’s decided to follow another route for their unique advanced technology: They decided to get their supervised Full Self-Driving (FSD) accepted in Europe via the Dutch RDW, using Article 39 of EU Regulation 2018/858. The result is they will be allowed to use it for 3 years, after which it will need to be revieuwed… Then, we have a very good chance the UNECE will have their ADS regulation ready. ADAS regulation may then be used by some less advanced manufacturers to test their less advanced systems… Let’s break it down! Why Article 39 instead of UNECE regulations? * Faster and more flexible than waiting for the UNECE DCAS or ADS rules. * Tesla used the process before and can use it now for new technology exemptions. * Tesla’s approach to getting supervised Full Self-Driving (FSD) approved in Europe through the Dutch RDW using Article 39 of EU Regulation 2018/858, rather than the UNECE DCAS regulation, reflects their unique technology and regulatory strategy. Can they get approval for FSD in the Netherlands?
